Basalt wants to drop open records lawsuit

  The town of Basalt wants to end a lawsuit that was filed over an open records request.

Basalt had filed the suit as a way to ask a judge to review the records request, which involved deleted text messages between a mayoral candidate and the town’s election official. A resident wanted to see those texts to determine if the spring election was run properly.

Basalt has since shared new information about the text messages with the requesting resident, and the town attorney says the suit should be dropped now. The new details only show when messages were sent. It’s not possible to see what the texts said, since they were deleted too long ago to be retrieved.

The resident who requested the texts said she’ll request that Basalt pay for the expenses she incurred from the lawsuit. So far that adds up to about $2,200. She also wants the judge to review a recent town council executive session to determine why the lawsuit was filed in the first place.
